Privacy Policy — LipaSafe

1. About LipaSafe

LipaSafe is a mobile escrow payment platform operated by Vezoro Enterprice (BN-VZSE95E3), registered in Kenya. We hold funds in escrow via Safaricom M-Pesa Daraja API and release payment only when both parties confirm a deal is complete.

LipaSafe is not a bank and does not hold a deposit-taking license. We are a payment intermediary facilitating escrow arrangements between M-Pesa users.

2. Eligibility

Be at least 18 years of age
Hold an active Safaricom M-Pesa account on a Kenyan phone number (+254)
Own or have authorized access to the Android device you use
Agree to these Terms and our Privacy Policy
Be located in Kenya

3. How the Escrow Service Works

Deal creation: Buyer and seller agree on terms and create a deal reference inside the app
Payment into escrow: Buyer pays via M-Pesa STK Push. Funds held in LipaSafe's ledger — not yet sent to seller
Delivery: Seller delivers goods or services as agreed
Confirmation: Buyer confirms receipt in the app, triggering automatic M-Pesa B2C payout to seller
Disputes: Either party may raise a dispute with evidence before confirmation. Admins review and resolve fairly

4. Platform Fees

Displayed clearly before a deal is confirmed
Deducted automatically from the transaction amount
Non-refundable once a transaction has been initiated

LipaSafe does not charge for failed transactions, cancelled deals (before payment), or approved refunds.

5. User Responsibilities

Provide accurate information when creating your account and deals
Use LipaSafe only for lawful transactions between consenting adults
Not use LipaSafe for illegal goods, controlled substances, or counterfeit products
Not file false or fraudulent disputes
Not attempt to manipulate, hack, or exploit the platform
Confirm deals honestly — do not refuse confirmation after receiving goods without valid grounds
Keep your account credentials and OTP codes confidential

6. Prohibited Transactions

Illegal goods or services of any kind
Pyramid schemes, Ponzi schemes, or multi-level marketing payments
Gambling or betting payments
Transactions involving minors
Money laundering or financing of any illegal activity
Counterfeit currency, documents, or goods

Violations result in immediate account suspension and may be reported to Kenyan authorities.

7. Disputes and Refunds

Either party may raise a dispute within the agreed deal timeframe
Evidence (photos, videos, messages) must be submitted to support the dispute
LipaSafe admins review evidence and make a final determination
Approved refunds are processed via M-Pesa within 1–3 business days
LipaSafe's admin decision is final for platform disputes

LipaSafe facilitates resolution but cannot guarantee fund recovery in all cases of third-party fraud.

8. Limitation of Liability

LipaSafe's liability is limited to the amount of the specific transaction in dispute. We are not liable for:

Losses caused by Safaricom M-Pesa downtime or failure
Losses arising from failure to secure your account credentials
Indirect, consequential, or punitive damages of any kind
Losses from transactions conducted outside LipaSafe's platform

9. Account Suspension and Termination

LipaSafe reserves the right to suspend or permanently ban accounts that file fraudulent disputes, engage in prohibited transactions, attempt to exploit the platform, or violate any provision of these Terms. Suspended accounts with funds in escrow will have those funds handled via the dispute resolution process.

10. Changes to Terms

We may update these Terms periodically. We will notify you via in-app notification. Continued use of LipaSafe after notification constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Kenya. Any disputes arising from these Terms or your use of LipaSafe shall be subject to the jurisdiction of the Kenyan courts.
